The General Terms and Conditions of the Company Namibia Holidays Tours & Safaris
This travel contract is between the customer and Namibia Holidays Tours & Safaris. In relation to this travel contract, a booking is defined as a reservation, which is carried out by the customer or the customer’s travel agency. The customer is defined as the person who accepts the booking on behalf of himself. The contract is effective from the date on which the invoice is complete and the deposit mentioned has been received by Namibia Holidays Tours & Safaris according to the transferred invoice. Travel agency is defined as an agency that makes or accepts a booking for a person or group of people or companies with Namibia Holidays Tours & Safaris. By making a reservation with Namibia Holidays Tours & Safaris and paying the deposit, the client or the travel agency accepts these terms and conditions as part of the agreement and acknowledges to be bound thereby. The travel contract is subject to Namibian law.
Deposits and Payment
After receipt of the travel confirmation, a non-refundable deposit of 20% of the total travel fee is due, the remaining amount is due and payable at least 45 days before the departure date. In the case of bookings made less than 45 days before departure, the full amount is payable immediately. Please note that bank transfers from abroad to Namibia (depending on the bank) can take up to 28 days. It is extremely important to send proof of payment to Namibia Holidays Tours & Safaris for each payment on the part of the customer, which is confirmed immediately after receipt of the amount. If the Company does not receive the full contract price 45 days before the departure date, the Company may cancel the reservation and retain whatever deposit or other funds it has already received from the client or his agent. The costs for the transfer of the funds are for the account of the payer. Should payment not be made as stipulated, the Company is entitled to cancel all bookings and to hold the Customer / Agent responsible for cancellation charges.
The cancellation must be made in writing. Upon receipt of the written notice, Namibia Holidays Tours & Safaris will confirm receipt and on this date the following fees will be set:
Up to 28 days before departure: deposit expires
28 to 21 days before departure: 30% of the total price expires
21 to 14 days before departure: 50% of the total price expires
14 to 7 days before departure: 75% of the total price expires
Less than 7 days before departure: 100% of the total price expires
It is imperative that the customer has cancellation insurance. Please note that if the reason for the cancellation falls under the terms of holiday insurance that the customer must have, these fees will normally be reimbursed to the customer by the insurance company, subject to the conditions of the insurance. Passport and Visa
Travel agencies and customers must ensure that passports and visas are valid for the countries visited. Namibia Holidays Tours & Safaris cannot be held liable or responsible if a customer is refused entry to any country for any reason.
Changes and Delays
From the company: The company reserves the right to change any tour due to unforeseen circumstances (e.g. airlines that do not fly according to plan, road conditions, weather, mechanical failure, accidents and political instability) which are beyond the control of Namibia Holidays Tours & safaris lie. The company will attempt to provide reasonable alternatives, but will not accept liability.
By the customer: If the customer changes the trip on his own, the company will try to take the customer into account, but may charge cancellation fees. This is subject to a new offer, which is given to the client in writing.
Authority on Tour
At all times, the tour guide’s decision is final in all matters that could endanger the safety and well-being of customers or the group. The customer must strictly comply with the laws, customs and currency regulations of all countries visited at all times. Should the customer be discovered in the event of any violation of the law, the customs or exchange regulations, the tour guide can instruct the customer to leave the tour without a refund. We reserve the right in our absolute discretion to terminate without notice the safari arrangements of any customer whose behaviour is such that it is likely in our opinion to cause distress, damage, danger or annoyance to our other clients, employees, property, any third party, to the animals or to themselves. If you are prevented from travelling because in the opinion of the tour guide you appear to be unfit to travel or likely to cause discomfort or disturbance to other passengers or the tour guide our responsibility for your safari thereupon ceases. Full cancellation charges will apply and we will be under no obligation whatsoever for any refund, compensation or costs you may incur.
It is the customer’s duty to ensure that they are medically fit to go on tour. We recommend vaccination against hepatitis before the trip. Anti-malaria precautions should be started before departure (valid for trips north) and customers should bring insect repellents on the tour. Clients who require special diets, vegetarians or allergic to any food stuffs, please, inform us well in advance prior to your departure from home. We will appreciate it if you would inform us way in advance about your medical conditions/ allergies etc.
Clients are limited to one soft sports type bag per person with a maximum weight of 15 kilograms. This includes photographic equipment and hand luggage. Due to the rugged terrain, the Company cannot be held responsible for damage or loss of any personal items including bags, contents of bags or photographic and related equipment. Due to extremely dusty conditions, please ensure all bags are dust proof.
Namibia Holidays Tours & Safaris reserves the right to use photos and films taken during any of our tours without notice for general promotional purposes without payment or approval.
It is a prerequisite for traveling with Namibia Holidays Tours & Safaris that all customers have insurance for medical costs, luggage loss, cancellation / reduction, cancellation and personal accident. Liability / Responsibility
The customer should familiarize themselves with local practices. Namibia Holidays Tours & Safaris and employees act in all matters in the form of agents for the customers and under no circumstances are they responsible and exempt from any liability that could arise for accidents, injuries, delays, losses or damage. The same applies to property or any other loss or damage that may arise. All tours are subject to the terms and conditions of the airlines, accommodation, restaurants and all other companies involved.
